Il locatario (cliente/capogruppo) di biciclette o attrezzature di FASSA RENT, la cui firma figura sul presente contratto, prende in consegna la bicicletta e/o altre attrezzature alle clausole e condizioni enunciate sul presente contratto che il locatario accetta e si impegna a rispettare.
1. Il cliente si assume la piena responsabilità dell'attrezzatura presa a noleggio.
2. La bicicletta e/o attrezzature dovrà/nno essere riconsegnata/e nel rispetto degli orari sottoscritti e/o affissi nel punto di noleggio, nello stesso luogo in cui è stata noleggiata. Nel caso in cui il cliente non rispetti gli orari di rientro come pattuiti sul contratto di noleggio, verrà applicata una penale di € 10 se il ritardo è inferiore a 30 minuti oppure una somma equivalente al noleggio della 1/2 giornata se il ritardo supera i 30 minuti successivi, pagati alla consegna del mezzo (vedi listino prezzi).
3. Prima di prendere possesso della bicicletta e/o attrezzature il locatario dovrà effettuare il pagamento secondo le tariffe in vigore al momento del noleggio.
4. Prendendo in consegna il mezzo il cliente riconosce l'attrezzatura in buono stato ed efficiente e dichiara di averla preventivamente controllata; al suo rientro verrà nuovamente controllata e nel caso di rotture dovrà pagare i relativi danni creati.
5. La bicicletta e/o l'attrezzatura sono da utilizzarsi esclusivamente come mezzo di trasporto ed è da trattarsi con attenzione, buon senso e diligenza. Il cliente deve utilizzare il mezzo in modo da evitare danni, sia alla stessa che ai relativi accessori.
6. Il cliente deve rispettare le norme del codice della strada, norme che dichiara di conoscere. Il Locatore declina ogni responsabilità in caso di utilizzo improprio del mezzo e di mancato rispetto delle norme del codice della strada.
7. L'uso della bicicletta e/o delle attrezzature presuppone l'idoneità fisica e la perizia tecnica di chi intende condurla. Pertanto il cliente, noleggiando la bicicletta e/o le attrezzature dichiara di essere dotato di adeguata capacità e di appropriata competenza senza porre alcuna riserva.
8. Qualsiasi fatto, danno o infortunio conseguente alla circolazione ed all'uso della bicicletta e/o delle attrezzature è imputabile al solo utente conducente. Il cliente è quindi responsabile dei danni causati durante l'utilizzo del mezzo a sè stesso, a terzi, a cose, alla bicicletta e/o alle attrezzature. Al Locatore non potrà essere richiesta alcuna forma di indennizzo.
9. Nel caso di danni e/o rotture causati al mezzo noleggiato il cliente dovrà pagare i danni causati che saranno quantificati dal locatore al momento della riconsegna del mezzo.
10. In caso di rottura totale o di furto il materiale in oggetto sarà addebitato al locatario secondo il valore di mercato.
11. La sostituzione è possibile durante la durata del contratto con materiali di diverse categorie e valori, con addebito della differenza in caso di categoria superiore, però senza rimborso in caso di categoria inferiore.
12. L'uso della bicicletta è riservato ai soggetti di età non inferiore ai 18 anni di età a meno che il minorenne sia accompagnato da persona maggiorenne che se ne assume la responsabilità.
13. lI locatore potrà rifiutare il noleggio della bicicletta o accessori a persona non ritenuta in grado di condurla (a norma degli articoli 186 e 187 del Codice della Strada) o per altri motivi e comunque a insindacabile giudizio del locatore stesso.
14. Il contratto di noleggio non prevede nè il recupero del mezzo nè di persone. Qualora richiesto tale servizio, il costo è di 30 euro a persona/mezzo se il recupero avviene in Val di Fassa, altrimenti viene calcolato un costo di 2,00€ a km percorso sia di andata che di ritorno. Il mezzo sarà sostituito esclusivamente nel punto di noleggio FASSA RENT, il cliente si impegna a riconsegnare il mezzo e/o attrezzature nel punto FASSA RENT strada de Meida 106 - San Giovanni di Fassa in cui ha sottoscritto il contratto di noleggio.
15. La risoluzione anticipata del contratto di noleggio é possibile mediante la restituzione del materiale senza pretese di rimborso da parte del locatario.
16. Rimborsi si effettuano esclusivamente per malattia e/o infortunio mediante l'esibizione di un regolare certificato medico.
17. La sottoscrizione del contratto di noleggio da parte del cliente presuppone la conoscenza e l'accettazione incondizionata del presente regolamento, delle norme di legge richiamate, delle tariffe, dell'orario di apertura e chiusura del servizio di noleggio.

7.The customer declares by renting the bicycle and / or the equipment, to have adequate capacity and appropriate competence without placing any reservations.
8. Any fact, damage or injury resulting from the circulation and use of the bicycle and / or equipment is attributable to the customer only. The customer is therefore responsible for damage caused during the use of the equipment to himself, to third parties, to things, to the bicycle and / or to the equipment. No form of compensation may be requested from the Lessor.
9. In the event of damage and / or breakages caused to the rented equipment, the customer will have to pay the damage caused which will be quantified by the lessor.
10. In the event of total breakage or theft, the material in question will be charged to the lessee according to the market value.
11. Replacement is possible during the duration of the contract with materials of different categories and values, with the difference being charged in the case of a higher category, but without reimbursement in the case of a lower category.
12. The use of bicycles is reserved for persons not under the age of 18 unless the minor is accompanied by an adult who assumes responsibility for the minor.
13. The lessor may refuse the rental of the bicycle or accessories to a person not deemed able to ride it (pursuant to articles 186 and 187 of the Highway Code) or for other reasons and in any case at the sole discretion of the lessor.
14. The rental contract does not provide for the recovery of the equipment or of people. If this service is requested, the cost is € 30 per person / bike if the recovery takes place in Val di Fassa, otherwise a cost of € 2.00 per km traveled both outward and return is calculated. 15. The early termination of the rental contract is possible by returning the material without any claims for reimbursement by the lessee.

17. The signing of the rental contract by the customer presupposes the knowledge and unconditional acceptance of this regulation, of the aforementioned laws, of the prices, of the opening hours of the rental point.

Der Mieter (Kunde/Gruppenleiter) des Leihmaterials von FASSA RENT, stimmt den Vertragsbedingungen in vollem Umfang zu.

1. Der Kunde übernimmt die volle Verantwortung für das Leihmaterial.
2. Das Leihmaterial muss innerhalb der ausgehängten öffnungszeiten zum Mietort, zurückgebracht werden. Für den Fall, dass der Kunde denen im Mietvertrag vereinbarten Rückgabetermin nicht einhält, sind bei einer Verspätung von weniger als 30 Minuten 10 € zu entrichten, wenn die Verspätung 30 Minuten überschreitet wird die halbe Tagesmiete berechnet.
3. Vor Übergabe des Leihmaterials wird der Mietpreis entrichtet.
4. Mit Übergabe des Leihmaterials bestätigt der Kunde den einwandfreien und funktionstüchtigen Zustand und erklärt dieses zuvor geprüft zu haben; Bei der Rückgabe kommt der Kunde für evtl. Schäden auf.
5. Das Leihmaterial ist ausschließlich als Transportmittel zu verwenden und mit Sorgfalt zu behandeln. Der Kunde hat das Material so zu benutzen, dass keine Schäden entstehen.
6. Der Kunde erklärt die Regeln der Straßenverkehrsordnung zu kennen und einzuhalten. Der Vermieter lehnt jede Verantwortung bei unsachgemäßer Verwendung des Leihmaterials und Nichteinhaltung der Vorschriften der Straßenverkehrsordnung ab.
7. der Kunde erklärt mit der Anmietung des Leihmaterials sachgemäß damit umzugehen.

8. Für sämtliche Sach- oder Personenschäden (auch an Dritten), die durch die Benutzung des Leihmaterials entstehen, haftet der Kunde. Vom Vermieter kann keinerlei Entschädigung verlangt werden.
9. Im Falle von Schäden am Leihmaterial haftet der Kunde in vollem Umfang. Der Betrag wird vom Vermieter bei Rückgabe des Leihmaterials festgelegt.
10. Bei Totalschaden oder Diebstahl wird das betreffende Material dem Mieter zum Marktwert in Rechnung gestellt.
11. Der Umtausch des Verleihobjekts während der Vertragsdauer gegen gleichwertige Artikel oder Artikel höherer Kategorien ist jederzeit gegen Aufpreis möglich. Die Rückvergütung beim Tausch gegen Artikel preiswerterer Kategorien ist jedoch nicht möglich.
12. Die Benutzung von Fahrrädern minderjähriger Personen ist nur in Begleitung eines Erwachsenen der die Verantwortung dafür übernimmt möglich.
13. Der Vermieter kann die Vermietung des Leihmaterials an eine Person ablehnen, die als nicht fahrfähig gilt (gemäß Artikel 186 und 187 der Straßenverkehrsordnung) oder aus anderen Gründen und in jedem Fall nach alleinigem Ermessen des Vermieters.
14. Der Mietvertrag sieht keine Rückholung des Leihmaterials oder von Personen vor. Wird dieser Service gewünscht, betragen die Kosten 30,00 € pro Person / Fahrzeug, wenn dies im Fassatal erfolgt, ansonsten werden 2,00 € pro gefahrenem km Hin- und Rückfahrt berechnet. Das Leihmaterial wird ausschließlich im Geschäft FASSA RENT ersetzt, der Kunde verpflichtet sich, das Leihmaterial an der FASSA RENT-Strada de Meida 106 - San Giovanni di Fassa zurückzugeben, wo er den Mietvertrag unterzeichnet hat.
15. Die vorzeitige Beendigung des Mietvertrages ist durch Rückgabe des Materials ohne Erstattungsansprüche des Mieters möglich.
16. Erstattungen erfolgen ausschließlich bei Krankheit und/oder Verletzung unter Vorlage eines regulären Arztzeugnisses.
17. Der Abschluss des Mietvertrages durch den Kunden setzt die Kenntnis und vorbehaltlose Annahme dieser Regelung, der vorgenannten Gesetze, der Tarife, der Öffnungszeiten des Mietservices voraus.
